IP Updates Myanmar: New requirement regarding Declaration of IPR
 

The long awaited Intellectual Property Law has not yet been enacted in Myanmar; The IPRs are registered under the Registration Act by filing a Declaration of Ownership at Office of the Registrar of Deeds in Yangon, Myanmar, ORD. 

As far as you may know, the Declaration of Ownership is only required to be executed by a simple signature of the Applicant. However, in order to strengthen validity of the Declaration, as from June 1, 2016 the Declaration will additionally be required to be certified by a notary public.

In case you are proceeding with execution for IPR in Myanmar, please take note this for a sufficient document. 

Summary required document as from June 01, 2016

 

(i) A Power of Attorney, which should be executed by a legal representative person of Applicant, then certified by a Notary Public, then legalized by a Myanmar Embassy or Consulate in the country of Applicant; 

 

(ii) A Declaration of Ownership, which should be executed by a legal representative person of Applicant, then certified by a Notary Public (the same person, who signed on the Power of Attorney is recommended); 

 

(iii) A specimen of the trademark in JPG. file with resolution at least 300DPI.
